PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING ANY COMPETITION OR PRIZE DRAW HELD ON OUR SITES

 

General

1               These competition and prize draw terms and conditions together with any specific rules set out in any Promotion Notice (as defined below) are the promotion’s Rules (“Rules”) and apply to competitions and prize draws (“Promotions”) featuring on any of our websites including (without limitation) www.amandaprowse.org, www.headofzeus.com (“our sites”).  By entering a Promotion, entrants agree to be bound by the Rules.

2               Rules specific to each Promotion are displayed in a notice on the page for such Promotion (“Promotion Notice”) and are incorporated into the Rules.  In the event of any conflict between these terms and conditions and the Promotion Notice, the Promotion Notice will prevail.

3               Each Promotion is run by or on behalf of Head of Zeus Limited (“We”).  We are a limited company registered in England and Wales under company number 7769235 and have our registered office at 131 Edgware Road, London W2 2AP.  Our main trading address is Clerkenwell House, 45-47 Clerkenwell Green, London EC1R 0HT.

4               We reserve the right to cancel or amend a Promotion or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or threatened breach of any applicable law or regulation, or any other event which is outside our reasonable control.  Any changes will be posted either within these terms and conditions or the Promotion Notice.  A copy of the Rules may also be obtained by contacting us at info@headofzeus.com.

5               In the event of any dispute regarding the Rules, conduct, results and all other matters relating to any Promotion, the decision of the judge(s) will be final and no correspondence or discussion will be entered into.

Qualifying Entrants

6               To qualify to enter any Promotion, you must be an individual resident in the United Kingdom, entering for your private and domestic (i.e. non-business) use.  Additional eligibility requirements may apply (for example, a valid passport may be required if a prize includes travel outside the UK).

7               Employees of Head of Zeus Limited and their immediate families, and any person connected with the Promotion and their immediate families (including the providers of the prize) are not eligible to enter.

8               By entering a Promotion, you warrant that all information you submit is true, current and complete, and that you are aged 18 or over.  We reserve the right to verify your eligibility.

9               We reserve the right to disqualify an entrant if we have reasonable grounds to believe that he has breached any of the Rules.  In the event of any such disqualification, we may (in our sole discretion) decide whether a replacement should be selected.  Any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.

Entries

10            Only one entry per person per Promotion is permitted.  Any entrant who enters more than this will be disqualified and we reserve the right to select an alternative winner (on the same criteria as the original winner and subject to these Rules).

11            Entries must be made in the manner and by the closing date specified on the Promotion Notice.  Failure to do so will disqualify the entry.

12            There is no purchase requirement to enter an online Promotion and no charge to register with any site if registration is required as part of the entry process.

Prizes

13            Prize winners will be chosen at random, unless specified otherwise in the Promotion Notice, from all qualifying entries within 14 days of the closing date specified in the Promotion Notice.  In all matters, the decision of the judge(s) will be final and no correspondence or discussion shall be entered into.

14            Prize winners will be notified in the manner and within the time specified in the Promotion Notice.  Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternative winner.

15            We may publish the names of the winners of Promotions on our sites.

16            Claims for prizes must be made in the manner and within the time specified in the Promotion Notice.  Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.

17            Prizes are non-transferable and unless otherwise stated, there is no cash alternative.  We reserve the right to substitute prizes of equal or greater value at any time.

18            All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses and upgrades and the like) as the case may be, are, unless otherwise expressly stated, the sole responsibility of the prize winner.

Intellectual Property Rights and Use of Entries

19            We do not (unless otherwise agreed with you) claim any rights of ownership in your entry.  You therefore retain ownership and copyright in the same.  Although you allow us to use your entry in accordance with the Rules, you will also have the right to use your entry in any way you choose.  Where any entry is to be used in a different way (for example, if we are asking to own your entry) this will be made clear in the Promotion Notice.

20            In consideration of us agreeing to consider your entry to the Promotion, you agree that we (and any third party authorised by us) may make your entry available on our sites and any other media, and grant to us (and any third party authorised by us) a non-exclusive, worldwide, irrevocable licence to use, display, publish, transmit, copy, make derivative works from, edit, alter, store, reformat, sell and sub-licence the entry for such purposes.

21            Your entry and any information submitted by you must be personal to and relate specifically to you.  You hereby warrant that your entry and all such information will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent or threatening. We do not guarantee to use or make available any entry on our sites.  We may, in our sole discretion, reject, edit, remove or disable access to entries that are in breach of this warranty.

Liability

22            Nothing in the Rules excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

23            To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Promotion or the provision of any prize, whether express or implied.

24            We are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the internet or at any site, or any combination thereof.  No responsibility is accepted for lost entries and proof of despatch will not be accepted as proof of receipt.

25            We will not be liable to any entrant for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the entry into (or inability to enter) the Promotion, or the provision, lack of provision, acceptance or non-acceptance, of any Promotion prize.

Data Protection and Publicity

26            The winner may be requested to participate in promotional activity related to the Promotion and the winner will participate in such activity on our reasonable request.  The winner consents to the use by us and our business partners, suppliers and sub-contractors, both before and after the closing date of the Promotion, of the winner’s name, voice, image and photo for publicity, advertising, marketing and promotional purposes without additional compensation. 

27            Any personal data relating to entrants will be collected and used in accordance with our privacy policy. By entering any Promotion, you agree to the collection and use of your data in accordance with this policy. 

Applicable Law

28            The Promotion and the Rules will be governed by English law.  You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction in respect of any dispute.  If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

COMPETITION RULES

30            This competition is subject to the general competition and prize draw terms and conditions set out here [HEAD OF ZEUS COMPETITION AND PRIZE DRAW TERMS AND CONDITIONS] as well as the following specific rules (together the “Rules”).  By entering this competition, you agree to be bound by the Rules.

31            This competition is promoted by Head of Zeus Limited (“We”) (a limited company registered in England and Wales under company number 7769235 with registered office at 131 Edgware Road, London W2 2AP). 

32            To enter the competition, you must tweet what your dog is reading using #Sirius @Foyles and/or @HoZ_Books. Include a photo of your dog reading and you'll be entered into the draw twice, and double your chances of winning.

33            One winner will be selected from a random draw of all correctly submitted entries received in accordance with the Rules.  The draw will be performed by a random computer process.  Once a winner is selected in this manner, we will manually check the winner’s entry to ensure that it is valid and conforms to the Rules.

34            All entries must be received by 23.59pm on 30th September 2015.

35            The winner will be contacted by twitter within 14 days of the closing date of the competition, and is required to confirm acceptance within 7 days of notification.  If we are unable to contact the winner, the winner is unable to confirm their acceptance of the prize in accordance with these Rules or rejects the prize, or the entry is invalid or in breach of the Rules, we reserve the right to award the prize to an alternative winner drawn in accordance with these Rules.  We may ask the winner to provide proof of age and / or country of residence.

36            The winner will receive £100 Foyles Gift Card (terms and conditions apply) and these bookends

37            We accept no responsibility for any costs associated with the prize and not specifically included in the prize.  

38            It is the responsibility of the winner to:

·  organise and pay costs associated with any travel needed to claim the prize

39            All elements of the prize are subject to availability and are non-transferable. 

40            Events may occur that render the competition itself or the awarding of the prize impossible due to reasons beyond our control.  Accordingly, we may, at our absolute discretion, vary or amend this promotion and you agree that no liability shall attach to us as a result thereof.

41            The winner may be requested to participate in promotional activity related to the Promotion.  All entrants agree to the collection and use of their personal data in accordance with the Rules.

INFORMATION WE MAY COLLECT OR RECEIVE FROM YOU

HOW WE STORE YOUR PERSONAL DATA

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology.  Where we have given you (or where you have chosen) a password which enables you to access certain parts of our sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our sites; any transmission is at your own risk. The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
